Shockwave Energy – Terms and Conditions

Air Conditioning, General Electrical, Solar PV, and Battery Installations

By accepting our quote and proceeding with the works, you (the Customer) agree to be bound by these Terms and Conditions. These apply to all services and goods supplied by Shockwave Energy.

1. Scope of Work

Shockwave Energy agrees to supply and install the equipment and perform the works as specified in the accepted quotation. Any variations or additional work will be quoted and agreed in writing before proceeding.

We will perform all work with due care and skill, in compliance with relevant Australian Standards, building codes, CEC requirements (where applicable), and electrical safety regulations.

2. Workmanship Warranty

In addition to your rights under the Australian Consumer Law, Shockwave Energy offers a 5-year workmanship warranty on all installations from the date of practical completion. This covers defects in our installation workmanship and labour for air conditioning, general electrical, solar PV, battery systems, and associated works.

We will return to the site (at no labour charge for covered defects) to rectify issues attributable to our workmanship within a reasonable time.

Exclusions (these do not limit your ACL rights):

  • Manufacturer product defects or failures — these are handled directly under the manufacturer’s warranty. Shockwave Energy incurs no cost for manufacturer claims.

  • Damage from external factors (weather events, storms, hail, lightning, floods, fire, pests, accidents, misuse, neglect, or third-party work).

  • Pre-existing electrical infrastructure, wiring, or site conditions (unless included in the quote).

  • Power surges, grid issues, or lack of maintenance (e.g., filter cleaning for AC, panel cleaning for solar).

  • Modifications or repairs by unauthorised parties.

  • Normal wear and tear or acts of God.

Manufacturer warranties for panels, inverters, batteries, AC units, etc., are passed through to you and remain separate.

3. Equipment and Component Warranties

Equipment carries the manufacturer’s standard warranty only. Specific exclusions apply where relevant (e.g., no warranty for rodent/pest damage or pair coil/refrigerant lines due to external exposure). These do not affect your ACL rights.

4. Customer Responsibilities

You must:

  • Provide safe access, accurate site information, and all necessary approvals/permits.

  • Maintain the system per manufacturer guidelines.

  • Notify us promptly of issues.

Failure to do so may affect available remedies (to the extent permitted by law).

5. Payment Terms

Deposits and schedules are as per the quote. Late payments may incur interest and recovery costs. Title in goods remains with us until full payment.

6. Cancellation, Rescheduling, and Termination

Cancellations or rescheduling within 48 hours of scheduled works may incur reasonable costs. ACL cooling-off periods (e.g., for unsolicited sales) are fully honoured where applicable. We may terminate for breach or non-payment.

7. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, consequential, or incidental losses (e.g., loss of profit, business interruption) unless required by the ACL.

  • Our total liability for any claim is limited to re-performing the defective works or the cost of the original services/goods (at our discretion), except where the ACL provides otherwise for major failures.

This clause does not limit your non-excludable ACL rights.

8. Force Majeure

We are not liable for delays caused by events beyond our reasonable control (e.g., extreme weather, supply shortages, regulatory changes).

9. General Provisions

  • Governing Law: Laws of the relevant Australian state/territory.

  • Entire Agreement: This document and the quote form the full agreement.

  • Variations: Must be in writing.

Australian Consumer Law Guarantees Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the goods or services, you are entitled to:

  • a refund, replacement, or (for services) cancellation of the contract, plus compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods or services repaired or replaced if the failure does not amount to a major failure.

Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any non-excludable rights or remedies you have under the ACL or other applicable laws.
